The High Court of Delhi in Pooja Mehta and others v. Government of NCT of Delhi and others, 2024 SCC OnLine Del 7112 while considering the balancing rights of the parties as per the provisions of the Senior Citizens Act, 2007 and the Domestic Violence Act, 2005, has held that the Court must evaluate the nature of relationship between the parties and strike a balance between the Senior Citizens Act, 2007 and the Domestic Violence Act, 2005. In view of the above, I find no merit in the first contention raised by the petitioners.

Further, in Pooja Mehta (supra), Hon'ble High Court of Delhi held that the right of the mother in law, who was a senior citizen cannot be ignored, especially when there was a consistent pattern of ill treatment. Again, in the said case, the Divisional Commissioner after examination of evidence found that the daughter-in-law had created a hostile environment negatively effecting the quality of life of her mother-in-law. But in the instant case, parties are yet to lead the evidence.
