12. The case of Bai Dahi v. Shankerbhai Deojibhai, AIR 1954 Bom 214, was a case of a minor and although the observations of Chagla C. J. are of a somewhat wide character in regard to the powers under Section 151, C.P.C. and he seems to suggest that the Courts have very wide powers to restore suits under Section 151, C.P.C., independently of Order 9, Rule 9, but we prefer to consider this case as an authority confined to its peculiar facts and, as we have already pointed out, a minor was involved in this case.
