14. By way of reply, learned senior counsel for the
appellant reiterated his submissions and relied upon the
judgment of the Hon'ble Supreme Court in the case of
N.S.Vishwanatha Shetty vs. K.R. Shivaswamy and
others, [(2005) 11 SCC 130], to contend that Section
106 of the Evidence Act is not attracted to the instant case
as the prosecution has relied upon the eye-witnesses. He
reiterated that the impugned judgment may be set aside
and the accused may be acquitted of all charges against
him.
