In the case of Ram Phul Pandey v. Waned Ali Khan, 14 Suth WR 66 (A), it was held that a court has no power to refuse to summon witnesses when expressly requested by a party to do so, unless the witnesses are required to be summoned in such a manner or in such numbers as clearly indicates a vexatious desire of obstructing the course of justice.
