10. The judgment cited by the learned counsel for the
petitioners in the case of Nikhat Khan's case (supra) is not applicable to
the facts of the present case as no final decision upon the charge-sheets
issued to them has been taken by the respondents so far in the present
case whereas in the above cited judgment, the petitioners therein have
already been terminated without giving any opportunity of hearing.
