Piggot, J., in Mathura Praaad v. Karim Bakhsh 1915 All. 402 followed this ruling and held that there being no dominant heritage, such a right was not an easement, but "a customary right in the nature of an easement" and could be enforced. It may however be argued that if such a right is exercised by residents of a village their lands may constitute a dominant heritage.
