Temple Of Maruti, Situated At Cacoda, By ... vs Balkrishna Suryaji S. Kakodkar & ... on 13 February, 1998

32. The decision in Ram Das alias Ram Sura) v. Gandiabai (Smt.) and others is of crucial importance. In my opinion, referring to the controversy between the parties, it clearly lays down that while considering the evidence if no material evidence having direct impact is ignored, there cannot be any interference by the High Court. While it is being so asserted by the defendants, the plaintiffs have been submitting otherwise. Not only the documents produced by the plaintiffs have been wrongly misunderstood, according to them, but the evidence led by the defendants, oral and documentary both having direct impact on the question, has been ignored by the learned Appellate Judge. In view of the aforequoted proposition appearing at the end of para 15 of his Judgment, if this view of the plaintiffs is accepted, clearly interference by the High Court is called for.
