On the other hand, the reliance placed by the Counsel for the applicant on the judgment of the Karnataka High Court in the case of Ashish Suman v. National Law School of India University (supra) is also misplaced as the facts therein are entirely different and the alleged assault in that case was on a person who had nothing to do with University. In the case of the applicant, the alleged assault and use of abusive language is against a fellow employee of the same organisation. It is no doubt true that each and every misconduct committed anywhere irrespective of where and when it is committed cannot amount to misconduct merely because it has some remote impact on peaceful atmosphere in establishment.
