Rajbir and anr; 2016 SCC Online Del 3883, Lata Chauhan vs. L.S Bisht; 2010 (117) DRJ 715 is clearly mis placed since in the present case, the period of limitation did not commence at any time prior to the service of summons in the year- 2000. The Defendants have clearly not been able to prove the fact that the Plaintiff was aware about the occupation of the Defendants prior to the year 2000, hence the finding returned by the Learned Civil Judge holding the suit filed by the Plaintiff to be within the period of limitation cannot be said to suffer from any infirmity.

Accordingly, the finding returned by the Learned Civil Judge in as much as deciding is- sue No(s) 1 cannot be said to suffer from any infirmity in as much as hold- ing that the Defendant/ appellant herein has not been able to prove either their ownership either through perfection of title by way of adverse pos- session or otherwise.
