In Seshi Ammal v. United India Life Insurance Co. (1959) 2 M.L.J. 53 Subrahmanyam, J., referred to the presumption under Section 108 and stated that it would extend to the fact of death and not to the time of death at any particular period. The learned Judge observed that the exact time of death was not a matter for presumption but of proof by evidence by a person who claims a right for the establishment of which the fact is essential.
