Another thread of submission connected with this point was that on account of the criminal proceeding, the petitioner could not make an effective representation, as disclosure of his defence might prejudice him in his trial. This part of the submission is based upon a decision of the Calcutta High Court in Methai Lal Core v. District Magistrate 24-Parganas 1975 Cri LJ 295.
