4. Contending that he had not carried out any excessive cutting,
erasing or using of fluid on the OMR Sheet and that, therefore, the
cancellation of his candidature was illegal, the respondent approached
the Tribunal by way of OA 289/2017 (Rakesh Kumar v General
Manager, Northern Railway), praying that the afore-extracted
undated decision of the RRC, cancelling his candidature, be quashed
and that he be appointed to the appropriate Group D post.
Consequential benefits were also sought. Among other contentions,
the respondent submitted that cancellation of his candidature, without
issuing him any show cause notice, was violative of the law.
