14. I am also supported in my view by the decision of a coordinate
bench of this Court in Navjot Singh (supra). In the said case, an appeal
had been preferred against the judgment and decree passed by the
learned trial court under Order XXXVII Rule 3(6)(b) of the CPC on
non-compliance of conditions subject to which leave was granted. In
the appeal, this Court had observed as under:
