8. Thereafter, GEL approached the Chairman of NTECL for
appointment of an independent arbitrator and once again approached this
Court under Section 11 (6) of the Act for appointment of an arbitrator (ARB.
P. 365/2014 titled M/s Gangotri Enterprises Ltd v. NTPC Tamil Nadu
Company Ltd.). In the meanwhile, Mr Rakesh Samuel resigned as the sole
arbitrator. NTECL appointed Mr N. Sasikumar as the sole arbitrator in place
of Mr Rakesh Samuel. He entered the reference by his letter dated
20.01.2015 and fixed the arbitral proceedings on 17.02.2015. Admittedly,
GEL did not attend the said hearing and the proceedings were adjourned to
17.03.2015.
