No such averment is made in the plaint
that due to lack of jurisdiction, the plaintiff could not succeed in a suit or
on the point of defect of jurisdiction or other cause of like nature. Thus,
this ground has been raised by the ld counsel for the plaintiff is without
any basis and thus Section 14 of The Limitation Act does not applicable
in the present suit. Rather, during arguments, it is the case of the
parties that the plaintiff is defending a suit of injunction filed by the
defendant. Ld counsel for the defendant relied upon IInd Ltd. B. S.
Bamhrah Vs. Union of India 2000 (V) AD (Delhi) 865 wherein it was held
