In the matter of R. K. Divyeshwar (supra), Mr. Desai has specifically relied upon paragraph 26 of the judgment and more particularly clause 4 thereof. In paragraph 26 of the judgment, the Court has held that, 'thus, appreciation of evidence is strictly prohibited while exercising powers by the High Court .. ..
