12. Thus, in the present case, the spot and timing of the
incident as well as identities of the vehicles involved are not
disputed. The fact that accused Arun Singh was driving the
offending vehicle at the relevant time and place is also not
disputed, the same is also proved by testimony of PW-9/ owner of
the vehicle, reply to notice U/s 133 M.V. Act, further accused has
also not disputed the same. The factum of death of victims namely
Shri Chand Tarwani and Tript, is also not disputed, same is also

proved by their MLCs and Postmortem Reports exhibited on
record. Thus, the only contentious issue to be decided in the
present case is whether the said accident took place due to
rashness or negligence on the part of the accused Arun Singh.
