However, while upholding the Act in paragraph No.46 of the judgment, the Division Bench further indicated that the Court is not going into the quantum of enhancement of tax. It was left open to the institution to file appropriate petition challenging the same.

The fourth respondent erroneously rejected the proposal citing G.O(Ms)No.39, 4/10 https://www.mhc.tn.gov.in/judis/ W.P(MD)No.18114 of 2018 School Education (D1) Department, dated 21.03.2003 and denied the approval and prayed for allowing the Writ Petition.

Following such decision, the learned Single Judge of this Court in the case of 'Thiruvalluvar Higher Secondary School Vs. The Government of India, Department of Education and others' reported in '2008 (5) CTC 648', had taken a similar view that after lifting of the ban, approval of appointment to a non-teaching post in an aided school, requires to be made from the date of his initial appointment. Therefore, it is submitted that even though the writ petition was dismissed by this Court on 15.02.2011, it would not in any manner affect the case of the petitioner as the points canvassed in the writ petition have not been dealt with. Further, the learned counsel submitted that this Court by an order dated 12.04.2006 allowed another writ petition in W.P.No.11650 of 2006 (Tamil Nadu Higher Secondary School Headmasters Association, Ambasamudram, vs. The Secretary to Government and others), based on the stand taken in the counter affidavit and the said order was also implemented and the pension was revised for the three incumbents covered in the said order, by the order of the Accountant General dated 23.03.2006. Therefore, it is submitted that the stand taken by the respondents to deny the petitioners benefit is illegal.
