Although similar prayers of the applicant were earlier rejected by this Court, yet, the fact remains that when those applications were moved, the applicant had not completed 50% of the jail sentence and therefore, benefit of Section 436A was not available to him. Taking note of the observations made by the Supreme Court in the case of Saudan Singh (Supra) and Satender Kr. Antil (Supra) we are of the view that a new ground has become available to the applicant for preferring this application for the fourth time after he had completed half of the maximum jail sentence.
