In NIC Ltd. V. Geeta Bhatt AIR 2008 SC
1837 Hon'ble Supreme Court held that notwithstanding the fact that
licence possessed by driver is fake one, the insurer would not be
absolved from the liability to reimburse the insured. The owner is
bound to make a reasonable enquiry of the person who is authorized to
drive holds a valid licence. He is not required to verify the genuineness
thereof from the transport office. Hence, insurance company being the
insurer is liable to indemnify the insured u/s 149 of MV Act.
