For a period of three months, the criminal proceedings initiated in pursuance of the Sessions Trial No. 295 of 2018 (State versus Shyam Singh and others), arising out of Case Crime No. 012 of 2016 under Sections 323, 504, 506, 325 IPC and 3(1)(x) SC/ST Act, Police Station Sareni, District Raebareli, shall remain stayed so far as applicants are concerned.

The present application under Section 482 Cr.P.C. has been filed by the applicants praying for quashing charge sheet dated 30.09.2022 submitted in Case crime no. 0264 of 2021, under Sections 452, 354, 323, 34 IPC and Section 9(Chha)/10 POCSO Act, Police Station Sikandra, District Kanpur Dehat, which is registered vide case no. 857 of 2023 (State Vs. Shyam Singh and others), pending in the court of Additional District and Sessions Jude (Protection of Children From Sexual Offences Act), 2012, District Kanpur Dehat as well as cognizance and summoning order dated 18.05.2023 passed by Additional District and Sessions Judge (Protection of Children From Sexual Offences Act), 2012.

This appeal is directed against as many as ten accused/ respondents on account of fact that the aforesaid accused/ respondents stood trial under section 147, 148, 149, 307, 302 and 323 I.P.C. and under section 25 Arms Act, P.S.- Rampur, District- Saharanpur in Sessions Trial No.307/1984, 61/1985, 62/1985, 63/1985 (State Vs. Shyam Singh and others) whereby the accused/ respondents have been acquitted of the aforesaid charges.
This application under Section 482 Cr.P.C. has been filed to quash the summoning order dated 1.2.2020 passed by the Additional Civil Judge (S.D.) / Additional Chief judicial Magistrate, Baghpat in Case No. 1453 of 2012 (State Vs. Shyam Singh & Ors.), under Sections 406, 120B, 504, 506, 420, 468 and 471 IPC arising out of Case Crime No. 92 of 2012, Police Station Chhaprauli, District Baghpat.
The applicant/appellant has been convicted in Special Session Trial No.42 of 2014 (State Vs. Shyam Singh) arising out of Case Crime No.174 of 2013, under Sections 354ka, 506 I.P.C. and Section 8 of the Protection of Children from Sexual Offences Act, 2012, Police Station Mahila Thana, District Amroha and sentenced to undergo imprisonment of three years with fine of Rs. 3000/- under Section 506 I.P.C. and to undergo imprisonment of four years with fine of Rs.5,000/- under Section 8 of the Protection of Children from Sexual Offences Act, 2012 and in the event of default in payment of fine to undergo additional imprisonment for three months.
The present appeal under section 14-A(1) of Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act has been filed against the order dated 20.3.2021 passed by Special Judge, SC/ST Act, Muzaffarnagar in S.S.T. No. 76 of 2019, arising out of Case Crime No. 43-A of 2005 (State vs. Shyam Singh and others) under sections 147, 148, 149, 307, 323, 437, 504, and 506 IPC, Section 3(1)(X) and section 3(2)(X) of SC/ST Act, Police Station Chhapar, District Muzaffarnagar.
This application under Section 482 Cr.P.C. has been filed by the applicant to quash the charge sheet dated 13.03.2022, cognizance order dated 06.08.2022 in Criminal Case No.4155 of 2022 (State vs. Shyam Singh), arising out of Case Crime No. 285 of 2021, under Section 67 of Information Technology Act, Police Station- Kamalganj, District- Farrukhabad, pending in the Court of Chief Judicial Magistrate, Farrukhabad.
2-This application under Section 482 Cr.P.C. has been filed by the applicants to quash the Non-bailable warrant dated 20.04.2022 issued against the applicants in Case No. 404 of 2020 (State Vs. Shyam Singh and others) arising out of N.C.R. No. 0360 of 2018 and Case Crime No. 327 of 2019, under Sections 308, 323, 504 I.P.C., Police Station-Kotwali Gursahaiganj, District-Kannauj, pending in the Court of Judicial Magistrate, Kannauj.
Learned counsel for the applicant(s) submitted that both the parties have amicably settled their dispute outside the Court and have entered into a compromise and a true copy of compromise deed, duly signed by the parties, is annexed as Annexure No. 4 to the present application. As such, keeping in view the settlement arrived at between the parties and the law laid down by the Hon'ble Apex Court in this regard, the proceedings impugned are liable to be quashed.
