Mr. Ahmed further relies upon M/s. Maha Maya General Finance Co. Pvt. Ltd. v. Harjit Singh, Liquidator, National Planners Ltd. & another wherein the Learned Judge in the facts and circumstances of that case came to the conclusion that it must be presumed that the exemption applied for was granted by the court. There were two appeals arising out of the common judgment. Certified copy of the common judgment in one appeal had been filed and exemption was granted from filing the certified copy in the other appeal. In view of this fact there is no ground to exempt the appellant from filing the certified copy of the court of the instance i.e. the order dated 1/4/1976 passed by the Additional Controller, Delhi. It is therefore held that the appeal is barred by time.

21. For the aforesaid reasons these appeals are allowed with costs. The impugned judgments of the High Court are set aside resulting in the dismissal of the two writ petitions, namely, Writ Petition No. 16382 of 1992 - Delhi Auto & General Finance Pvt. Ltd. v. State of U.P. and Anr., and Writ Petition No. 25461 of 1992 - Maha Maya General Finance Co. Ltd. v. State of U.P. and Anr. The appellants are to get the costs form respondent No. 1. Costs fixed at Ra. 10,000 in each appeal.
