In her cross-examination by Ld. defence Counsel PW-2 deposed that Page No. 6/19 CR Cases 4649/2019 State Vs. Kiran her duty hours were from 08:00 AM on that day. She deposed that she do not remember the exact time when they left the PS. She deposed that she did not make any departure entry when left the PS. She further deposed that IO verbally asked 3-4 public persons to join the investigation but none joined the investigation. She further deposed that IO did not serve any notice to them on their refusal. She further deposed that IO had not prepared seal handing over memo at the spot. She further deposed that IO handed over the seal to Ct. Ram Chander after use. She deposed that IO recorded her statement at the spot. She lastly denied the suggestion that she was not present at the spot or that the case property was planted upon the accused.

On 04.07.2002, Inspector Rajender Bhatia recorded the disclosure statement of accused Honey vide memo already Ex.PW6/16. On 01.08.2002 Inspector Rajender Bhatia vide seizure memo already Ex.PW6/17, seized the vehicle entry register of D­8 Block in my presence, the same is bearing my signature at point A. The register is now Ex.P8A. On 20.08.2002 Sh. S K Tiwari seized the photocopy of lease deed of flat no. B­8/6177 Vasant Kunj and flat no. 1525, Sec­A, Pocket B and C Vasant Kunj vide seizure memo already Ex.PW7/12 and Ex.PW7/13. His statement was recorded by the IO on the relevant dates and time.

17. Since public persons were not joined in the investigation, the departure entry of the aforesaid police official namely Ct. Ram Chander, who was FIR No. 490/2020 Page No. 12/18 CR Cases 7544/2021 State Vs. Kiran allegedly on patrolling duty at the relevant time and had apprehended the accused with case property, becomes a vital piece of evidence. No such daily diary entry regarding departure of PW-1 is, however, present on record. Despite of cross-examination of the witnesses qua the said departure entries by the witnesses the prosecution was not able to bring on record any proof of the said entries, and the same is indispensable as the present case rests solely on the alleged recovery made by the aforesaid police official.

6.1) HC Raj Kumar, was examined as PW1, who deposed that on 13.07.2021, he was posted as Head Constable at PS Kirti Nagar, on that day, Ct. Naveen was on area patrolling duty within the area of the police station and the further investigation of the present case was marked to him and he along with W/Ct Savita went to the spot i.e. near Reservation Officer Railway, Kirti Nagar where Ct. Naveen had apprehended one lady in possession of one plastic katta containing CIS No. 1664/2022, State Vs. Kiran; FIR No.316/2021; PS. Kirti Nagar; U/s. 33 Excise Act 2/10 CNR No. DL WT02-002958-2022 illicit liquor, then Ct. Naveen narrated the whole incident of recovery and he recorded Ct. Naveen's statement Ex.PW1/A, on checking the said plastic katta it was found containing illicit liquor 100 quarter bottles of make Santra Desi Sharab for sale in Haryana only 180ml each, then he separated one quarter bottle as sample and the remaining bottle were kept in the plastic sack and the pullanda was prepared, the pullanda and the sample bottle were sealed separately with the seal of RK and thereafter the plastic katta was seized vide seizure memo Ex.PW1/B and the seal after use was handed over to Ct.

IO SI Pramod Kumar prepared rukka State vs. Manoj Tyagi FIR No. 71/14 U/s 25 Arms Act PS Kamla Market Pages 3 of 11 and handed over to Ct. Ravinder for registration of FIR. Ct. Ravinder reached at PS and got registered the case. After sometime, Ct. Ravinder alongwith HC Anil Kumar came at the spot. The further investigation was marked to HC Anil Kumar. ASI Pramod Kumar handedover the case property i.e., sealed pullandas, relevant documents and custody of accused Manoj to HC Anil Kumar by narrating all the entire facts to HC Anil Kumar. HC Anil Kumar inspected the site and prepared the site plan. Accused Manoj Tyagi was arrested and personal search was carried out vide memo Ex.PW2/C and Ex.PW2/D respectively. The accused was interrogated and his disclosure statement was recorded vide Ex.PW2/E. Accused persons namely Manoj, Mohit and Vishal had disclosed that they had robbed the above revolver at Indian Oil Petrol Pump, NH­24, Mayur Vihar, Phase­II, from the person who were traveling in a car. On inquiry, it was revealed that at PS Kalyanpuri, a separate case of robbery of revolver was registered. The accused persons Manoj, Mohit and Vishal were arrested by ASI Pramod in a kalandara u/s. 41.1 (a) Cr.P.C. as they had disclosed the commission of robbery of recovered countrymade revolver. IO ASI Pramod Kumar had informed to PS Kalyanpuri for the same. Accused Manoj Kumar was got medically examined at LNJP Hospital and case property was deposited in Malkhana. He has identified the case property i.e., revolver and cartridges which is Ex.P1 (colly).

Employees State Insurance Corporation ... vs R.P. Maurya Son Of Ajodhya Prasad on 21 August, 2007

In my opinion, the judgment of the Supreme Court in Executive Committee of U.P. State Warehousing Corporation Ltd. v. Chandra Kiran Tyagi [supra] is clearly distinguishable, inasmuch as the Regulations in that case were framed by the Central Warehousing Board in exercise of its powers which was not legislative in character. In the present case, Employees' State Insurance Corporation (Staff and Conditions of Service ) Regulations, 1959 [herein referred to as the Staff Regulations) the Staff Regulations framed are statutory provisions and has the force of law. To elaborate this issue, it would be appropriate to consider the provisions of the Employees' State Insurance Act, 1948.
