It is not in dispute and is even reflected in the communication dated 8.05.2015 of the Ministry of Defence that the judgment of the Jodhpur Bench of the Tribunal in Ram Kumar's case has attained finality. CWP No. 9927 of 2010 filed against it was dismissed by the Rajasthan High Court on 1st August, 2011. SLP No.8276/2012 was dismissed by Hon'ble Supreme Court on 8th May, 2012. The writ petition and the SLP have been decided after the order dated 09.04.2010 of the Jodhpur Bench Tribunal passed in the review application. It is not the case of the petitioners that the order dated 09.04.2010 has been reversed or set aside.

While impugning the order dated 13.01.2014 passed by the Central Administrative Tribunal, Chandigarh Bench, whereby Original Application of the respondents has been disposed of in terms of the order passed by the Jodhpur Bench of the Tribunal in OA No.34/2008 titled as Ram Kumar and others versus Union of India and another, one of the primary contention of the petitioner-authorities is that the official communication has been misread and mis-construed by the Tribunal as claim of the respondents was nowhere admitted or acknowledged by them. It is further urged that the matter has been considered at length by the authorities and a conscious decision has been taken vide order dated 4.6.2014.
