It is not in dispute that the Standing Orders provide that the Manager shall take into account the gravity of misconduct, the previous record, if any of the employee and any other extenuating or aggravating circumstances that may exist. Shri J.L. Bhoot would submit, and in all fairness Shri R.B. Puranik does not disagree, that in view of the decision of this Court in Mill Manager, Savatram Ramprasad Mills v. Industrial Court, Nagpur reported in 1987(1) BCR 517, the said provision is mandatory.
