8. We have also considered the judgments of the
Coordinate Bench namely Mohan Singh Meena Vs. Govt. of
NCTD and Ors. in OA No. 973/2016 decided on 10.08.2023
and in Devender vs. Govt. of NCTD and Ors in OA No.
1348/2017 decided on 20.09.2023. In both these cases, the
Tribunal has relied extensively upon the judgments of the High
Court as well as the Apex Court which are based on similar
circumstances as in the present case. The said judgments
