12. He, further submits that the view taken by the learned
Single Judge of this Court in the case of Akbar Ali (supra) is the
right view, therefore, proviso to Section 17(1) of the Act of 1887
will not apply to the case of the petitioner while seeking setting
aside ex parte decree passed by the Small Causes Court.
