Although the judgment had been dictated in open Court yet prior to it being signed, the Court has come across certain judgments of this Court passed in First Appeal From Order No. 477 of 2017 Inre; Sri Guddu and anr Vs. State of U.P and Ors decided on 18.11.2023 & First Appeal From Order No. 438 of 2010 Inre; Smt. Poonam Gupta Vs. Arun Kumar Mishra decided on 13.11.2019 which appear to have a direct bearing on the case which have not been cited by any of the learned counsels which dealt with the question as to whether in case the claim petition had been decided at an earlier stretch of time and subsequent thereto, during pendency of the appeal for enhancement if the statutory amount is enhanced as to whether the claimant would be entitled to the enhancement of amount in the appeal.
