In that case the Driver was found guilty of habitual absence without leave. Lesser punishment imposed on him on five earlier occasions had failed to bring about any improvement and in those circumstances the order of the Labour Court and Industrial Court holding that punishment of dismissal was shockingly disproportionate and directing reinstatement was patently erroneous.
