In the case of J.C. Joshi Vs. UOI and others
(supra), CAT, Principal Bench has observed that
applicant was transferred within a period of two years
before the date of superannuation, which is not the case
of the applicant. At the time of passing of impugned
transfer order, applicant has left more than 2 years of
service, hence this case law will not support the case of
the applicant.
