37. Reliance placed upon decision in the case of C. Venkata Swamy (supra), Vinod Kumar (supra), Bhagirathi (supra) and Rishikesh (supra) by appellant does not find any support as facts of present case are distinguishable from the same, as the sole case of plaintiff was that defendant refused to return money and on the basis of the document executed before the police authorities, he was bound to return the same. The lower appellate court after framing point of determination and discussing the case had allowed the appeal of defendant.

In Rishikesh v. Harikesh and Others, 2019 (1) ADJ 678, this Court held that a decree cannot be granted for property that is not clearly identifiable. It was observed that where there exists a discrepancy between the description of the property in the plaint and that in the sale deed relied upon by the plaintiff, rendering the identity of the property uncertain, the plaintiff cannot be said to have established their title or possession. The Court further emphasized that in the absence of clear demarcation or reliable evidence establishing the boundaries or location of the disputed property, the claim is liable to fail. The judgment reinforces the well-settled principle that no relief can be granted in respect of vague or unidentifiable immovable property.
