In our opinion, the High Court could not have
placed an outright reliance on Swaran Singh case
[Swaran Singh v. State of Haryana, 2012 SCC OnLine
P&H 19044], without considering the nature of
transaction relied upon in the said decision. The decision
could not have been applied ipso facto to the facts of the
instant case. In such cases, where such
judgments/awards are relied on as evidence, though they
are relevant, but cannot be said to be binding with
respect to the determination of the price, that has to
depend on the evidence adduced in the case.
