11. Learned Senior Counsel has relied upon two
judgments of this Court taking the same view,
namely, the oral order dated 02.11.2015 passed
in Admiralty Suit No.34 of 2015 - Vital
Ventures Ltd. v. M.V.Infinity and Croft Sales
and Distribution Limited v. M.V.Basil and Ors.
2011(2) GLR 1027, which has been upheld by
the Division Bench vide judgment dated
17.02.2011 rendered in OJ Appeal No.6 of 2011
in Admiralty Suit No.10 of 2010 and connected
matters, Croft Sales and Distribution Limited
v. M.V.Basil (IMO No.7532650) & Ors., referred
to hereinabove. It is submitted that the
judgment of the Division Bench in Croft Sales
has attained finality and is binding on this
Court.
