28. Mr. P.M. Raval, learned Advocate for the appellants, then invited my attention to the rejection of the revised plan issued under Section 29(1), 49 and Chapter XII of the B.P.M.C. Act and Rule 4 of the Rules, and submitted that in view of Section 6 of the Gujarat Town Planning and Urban Development Act, 1976, the Standing Committee alone is entitled to exercise powers and as there is nothing on record to suggest that the power was delegated under Section 68 of the B.P.M.C. Act and, even if it is so, the Commissioner cannot further delegate his powers. Reliance is placed on the decision of this Court in Devjibhai B. Chudasama and Ors. v. State of Gujarat and Ors. .
