Since several provisions of the 2014 Regulations, including Regulation 14(3) and its provisos, have undergone a substantial change from the earlier 2009 Regulations, the judgement of this Tribunal, in NTPC Ltd vs CERC & others (Order in Appeal No.129 of 2012 & batch dated 12.05.2015), which is based on the interpretation placed on the provisions of the 2009 Regulations, would not constitute a precedent binding on the subsequent Bench which had, in passing the judgement in NTPC Ltd vs Chairperson CERC & others (Order in Appeal No. 25 of 2017 dated 01.12.2022), interpreted the 2014 Regulations.

We find that the judgment of this Tribunal in the case of Uttar Pradesh Power Corporation Ltd. Vs. CERC & Ors 2011 ELR (APTEL) 0858 relied upon by the appellants also does not support the case of the appellants because in the present matters, the NTPC did not claim the actual O & M expenses qua normative and they had claimed the increase for the Page 41 employees' cost forming part of the O & M expenses which were not factored while considering normative O & M expenses and hence the said decision of this Tribunal cannot enure to the benefit of the appellants and not applicable to the present matters.

27. The learned counsel for the Central Commission informed that the issue of un-discharged liabilities forming part of the capital cost is squarely covered by the decisions of the Tribunal in its judgments dated 10.12.2007 and 16.3.2009 in Appeal Nos. 151 & 152/2009 and Appeal Nos. 133, 135, 136 and 148/2008 respectively. He further submitted that the Central Commission has filed Civil Appeals before the Hon'ble Supreme Court against the above said judgments of the Tribunal and the same are pending. Since no stay has been granted by the Hon'ble Supreme Court, the judgments of this Tribunal have been implemented by the Central Commission while revising the tariff of the generating stations of NTPC Ltd, based on additional capital expenditure for the period 2004-09. The Central Commission undertakes to implement the said judgment in respect of the generating stations of the Appellant herein and allow the un- discharged liabilities deducted from capital cost, subject to the final outcome of the aforesaid Civil Appeals.

7. The next issue is Disallowance of expenditure incurred as capital expenditure but booked in the books as revenue expenditure. On this issue, as admitted by the Learned Counsel for the Appellant, the judgments rendered by this Tribunal rejecting this ground as against the Appellant. The said judgment is in Appeal No.82 of 2009 NTPC Vs CERC & Ors ELR (APTEL)871 dated 27.7.2010. Accordingly, the ground of this issue is rejected as against the Appellant.

CERC and the same has been decided against NTPC, the Appellant.
