7. Learned counsel for the respondents has drawn our attention to the latest judgement of Hon'ble Delhi High Court in Dr. Mahabir Prasad Yadav vs. Lakshmibai College in W.P. (C) No. 13811/2019 dated 27.07.2020, 5 OA No. 1711/2015 Item No.19/C-I wherein the issue of grant of increments during the period of suspension has been dealt. The applicant submits that the ex-gratia payment to an employee kept under put off duty is eligible for enhancement upto 50% of the payment received during the first 90 days of his/her suspension if the prolonging of his suspension is not due to any factors attributable to him. In the present case the respondents do not have a case that the put off duty is being prolonged due to the fault/actions of the applicant. The matter of enhancement of allowance during the period of suspension was considered by the Hon'ble Supreme Court in a catena of cases and was also recently reiterated by the Hon'ble Delhi High Court in Mahabir Prasad Yadav v. Lakshmibhai College W.P.(C) No.13811/2019 decided on 27.07.2020. Further more, the applicant has not been issued with a valid charge sheet even after three years of put off duty.

11. The applicant has placed reliance upon the judgment of the Hon'ble High Court of Delhi in Mahabir Prasad Yadav v. Lakshmibai College, 272 (2020) DLT 270, wherein it has been categorically held that the discretion vested in the competent authority under Fundamental Rule 53 is not unfettered and Digitally signed by RACHNA KAPOOR RACHNA KAPOOR must be exercised on objective considerations. It has been observed that the authority is under an obligation 8 Item No.25(C-VI) O.A. No.81/2024 to examine whether the delay in continuation of suspension is attributable to the employee and to record reasons in support of its decision, and that mere continuation of suspension or pendency of proceedings cannot by itself justify denial of enhancement.
