The learned counsel has also placed reliance on the decision of the Apex Court in Smt. Rukmani Bai v. Collector (8) and decision of this Court in Devendra Singh v. Kalyan Singh (9), for the proposition that an award cannot be set aside, amended or modified by way of another suit in view of Section 32 of the Arbitration Act. It is held in all these cases that non- existence and invalidity of an agreement must be challenged by means of an application under Section 33 and not otherwise.
