The Committee has also erroneously applied
area restriction, which stands expressly repealed by Section 4 of the
Scheduled Castes and Tribes Orders (Amendment) Act, 1976, as
affirmed by the Hon'ble Supreme Court in Jaywant Pawar Vs. State
of Maharashtra and Others, (2018) 5 SCC 975, and any reliance
thereon is wholly untenable and deserves to be rejected outright.
