Learned counsel for the applicant argued that present case is a counter-blast of Criminal Case No. 3012 of 2019, (State Vs. Rukhsana and Others) arising out of 18 of 2019, under Sections 420, 467, 468, 471, 120-B, 196, 200 IPC read with Section 125 of Lok Pratinidhitva Adhiniyam, Police Station- Kotwali Shahar, District- Bijnor, in a Transfer Application (Criminal) No. 386 of 2019, (Rukhsana and Another Vs. State of U.P. and Another), this Court vide order dated 06.08.2019, has transferred the above case from Bijnor Judgeship to Moradabad Judgeship. Learned counsel for the applicant further argued that opposite party no. 2, is a practicing lawyer and President of Bar Association of Bijnor. Hence, he is influencing the proceedings resulting over likelihood of unfair trial with the applicant.
