this regard, it has been held by this Court in the case of
Vishwa Mitter and others (Supra) that the Civil Court
which was seized of the suit ending in a compromise, would
have been well advised to pass a decree in terms of the
compromise, but presumably under a mistaken advice or lack
of proper understanding of the correct legal provisions, it
dismissed the suit as having been compromised.
