Dr. Chhotalal Jivabhai Patel vs Vadilal Lallubhai Mehta And Ors. on 29 September, 1967
In Soonabai v. Tribhovandas N. Malvi 10 Bom. L.R. 337, an order passed by a single Judge of the High Court requiring security for costs from a woman under Section 380 of the old Code of Civil Procedure was held to be a "judgment" within the meaning of Clause 15. The order did not in so many terms direct that the plaintiff shall not be entitled to proceed with the suit but the direct and inevitable consequence of the order was that the plaintiff could not proceed with the suit so long as the security for costs was not given and the right to proceed with the suit was thus affected.
