5. The learned Departmental Representative fairly conceded that the facts
and circumstances of the instant case match with those of SET Satellite
('Singapore,) Pte. Ltd. (supra) decided by the Hon'ble jurisdictional High
court. Respectfully following the precedent we uphold the impugned order.
7.1 We further note that the appeal filed by the revenue against the order of the
Tribunal has been dismissed by the Hon'ble High Court vide decision dated 30.6.2011
in ITA NO.317 of 2010 as under:
