In Gur Dayal Prasad v. Raghunath Prasad, and the following relied on by Sri Poornaiah, the Division Bench has held that the partnership provided for the withdrawal of the partner who considered his rights have been purchased or desired to sell his share for some reason took away the right of any partner to dissolve the partnership and to bring the business of the mill to a standstill. It was held in those circumstances, the right to dissolution available under Section 44 was held not available.
