vi) In Mukesh Yadav v. State of U.P reported in 2018 (3) ADJ 611,
the Allahabad High Court held that IRC Guidelines shall not be a
basis for Rule 144. The learned Single Judge set aside the said
decision on the contention that the same was not decided on the
basis of public safety. The Single Judge ought to have seen that
the Central Government in its legislative wisdom has not found it
necessary to impose any restriction or condition in the grant of
retail outlets and also no restrictions can be imposed in the nature
of guidelines issued by State or its authorities.
