Learned counsel of the Respondents has vehemently argued that the delegation itself is improper and there cannot be a blanket delegation in light of Section 27 of the Waqf Act and she placed reliance upon a decision of this Court in case of Shaikh Saleemuddin s/o Shaikh Ameenuddin & Ors. Vs. Baba s/o Manna Quereshi & Anr.,1. When the said decision is perused, it can be seen that the issue before the learned Single Judge of this Court was revolving around framing of a scheme under Section 32 of the Act, which in fact was a scheme under Section 69, and the argument was, the Chief Executive Offcer had no powers to frame such a scheme. This judgment does not assist the parties in any way.
