In ILR (1962) Cut 152: (AIR 1962 Orissa 173), Parfulla Kumar Das v. House Rent Controller, Cuttack a Division Bench of this Court construed Section 6 of the Act and held that the only grounds on which a tenant could be evicted were those specified in Section 7 of the Act and it was immaterial whether tenancy was determined under the provisions of the T. P. Act or not and that notice under Section 106 of the T. P. Act was not necessary and was not a condition precedent to the institution of an eviction proceeding under Section 7 of the Act.
