The judgment rendered in Lohia Brass (Pvt.) Limited (supra) was later on followed by the Supreme Court in U.P. Power Corporation Limited and others Vs. Bonds and Beyonds (India) (P) Ltd. decided on 24.09.2007 reported in (2007) 7 SCC 779. It was again observed that each contravention of peak hours consumption restrictions penalty had to be levied separately. All such violations cannot be read together only because the violations have been recorded in one MRI report, they cannot be considered as one violation.

The General Secretary vs The Federal Bank Limited on 15 April, 2024

Aggrieved by the dismissal order, the petitioner raised the dispute before the Labour Court. The Labour Court framed a preliminary issue on the fairness of the domestic enquiry and vide impugned order dated 07.02.2020 held that the domestic enquiry was conducted in a fair and proper manner and the same did not call for any interference. Thereafter the Labour Court considered the dispute on merits. The Labour Court relying on the Judgment of the Apex Court in the case of U.P.Power Corporation Ltd. and another versus Lohia Brass (P) Ltd. and others reported in 2006 (7) SCC 220 and on facts confirmed the finding of the enquiry officer and the Appellate Authority.
