17. The Supreme Court in the matter of Ajaib Singh and another v.
Joginder Singh and another 11 while dealing with Section 559 of
the old Code i.e. the Code of Criminal Procedure, 1898, which is
pari materia to Section 35 of the present Code, has clearly held that
a successor-in-office of a Magistrate can file a complaint under
Section 476 of the CrPC, 1898 (old Code) in respect of an offence
under Section 195 of the IPC committed before his predecessor-in-
