As far as
the decision in Sagar Warehousing Corporation (supra) is concerned, the
Court in that case justified the passing of an interim order against an entity
which was not a party to the arbitration agreement by referring to Sections
9(1)(ii)(a) and 9(1)(ii)(e) of the Act on the ground that it was not intended
to protect and preserve the subject matter of the agreement which were the
goods kept in the warehouse. The goods sold were helicopters together
with their spares.
