Tarak Nath Sana's case, AIR 1948 Cal 207 on which reliance has been placed by Mr. Lodha was quite different inasmuch as the arrangement envisaged in it was one under which the so-called trustee was also expected to make a contribution to the fund and the agreement contained a provision for the division of the property between the parties if the purpose for which the arrangement was made was not carried out by the other party. That case can therefore be of no avail to the defendant.
